The Court of Cassation examines the appeals lodged against the final decisions (which are therefore no longer subject to appeal).
However, the Court of Cassation does not constitute a third level of jurisdiction since there are only two levels of jurisdiction in Belgium.
Its role is to check the due process and the legality of decisions against which ordinary remedies can no longer be brought.
A statement of appeal can only be validly introduced by a lawyer holder of a training certificate in cassation procedure in criminal matters.
